These Terms of Service (the “Terms”) govern access to and use of the digital experiences, applications, communications, intake workflows, and related services operated by Nova Charm (“Nova Charm”, “we”, “us”, or “our”). By engaging with any Nova Charm service, including the submission of onboarding forms or participation in our talent programs, you (“User”, “Model”, or “you”) agree to be bound by these Terms.
If you do not accept these Terms, you must discontinue use of the Services immediately. The Services are intended solely for individuals who are at least 18 years old (or the legal age of majority in their jurisdiction, if higher) and who have the legal capacity to enter into binding agreements.
Strictly 18+. You must complete identification verification and maintain accurate records to participate in Nova Charm’s programs.
You keep the rights to lawful content you create. You grant us limited licenses to manage, optimize, and showcase it in support of your brand.
Earnings are not guaranteed. All projections are illustrative, and you remain responsible for taxes and statutory compliance.
Illegal content, exploitation, hate, harassment, and unsafe performances are forbidden. Violations may trigger immediate suspension.
The digital properties, communications, events, and strategic support Nova Charm offers to talent.
An adult collaborator who applies to, is represented by, or participates in Nova Charm’s studio experience.
Any visitor, applicant, Model, or individual accessing or interacting with the Services.
Media, performances, likenesses, communications, data, or materials a Model provides or authorizes us to manage.
External services (e.g., streaming, fan platforms, payment processors) where Models may publish or monetize Content.
These Terms together with policies, statements of work, or onboarding documents explicitly referenced by Nova Charm.
By using the Services, you accept these Terms and any supplemental guidelines that may apply to specific programs or events. Supplemental terms prevail over conflicts within their scope. Continued participation after changes are posted constitutes acceptance of the revised Terms.
Nova Charm is a boutique talent studio providing strategy, brand elevation, performance guidance, content coordination, and concierge support. We are not a publisher of Model Content. Third-Party Platforms maintain independent policies and determinations regarding visibility, monetization, and moderation.
The Services do not guarantee bookings, earnings, audience growth, or platform acceptance. Illustrative metrics or case studies are provided for inspiration only.
Where Nova Charm issues login credentials or invites you into shared workspaces, you must maintain confidentiality and use the access solely for authorized purposes. Notify us immediately of any suspected compromise or unauthorized use.

Except for Model Content, the Services (including designs, text, graphics, logos, software, and trademarks) are owned or licensed by Nova Charm and are protected by intellectual property laws. You may not copy, adapt, translate, or create derivative works without our prior written consent.
You retain ownership of lawful Content you create. By providing Content to Nova Charm or authorizing our access, you grant a worldwide, non-exclusive, royalty-free, sublicensable (to service partners), and transferable license to host, store, transcode, evaluate, and use the Content solely for:

Third-Party Platforms maintain independent terms, community guidelines, and technical performance. You must comply with each platform’s requirements. Nova Charm is not responsible for platform outages, moderation decisions, policy changes, or data loss originating from those platforms.
Nova Charm processes personal data in accordance with our Privacy Notice (available upon request or via our website). Models collecting subscriber or fan data independently act as separate controllers or data stewards and must comply with applicable privacy regulations (e.g., GDPR, CCPA, ePrivacy marketing rules).

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” NOVA CHARM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, UPTIME, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT PERFORMANCES WILL ACHIEVE SPECIFIC RESULTS.
Where jurisdictional law does not allow the exclusion of certain warranties, those exclusions apply only to the maximum extent permitted.
TO THE FULLEST EXTENT PERMITTED BY LAW, NOVA CHARM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR MAXIMUM AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE SERVICES OR THESE TERMS IS LIMITED TO EUR 100 OR THE TOTAL FEES (IF ANY) PAID BY YOU TO NOVA CHARM IN THE THREE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not permit limitations on liability. In such cases, the limitations apply only to the extent allowed.
You agree to defend, indemnify, and hold harmless Nova Charm, its affiliates, directors, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of: (i) your use of the Services; (ii) your Content; (iii) your violation of these Terms; or (iv) the infringement of rights or laws by you or your Content.
Nova Charm may suspend or terminate access to the Services with or without notice if we reasonably believe you violated these Terms, applicable law, or pose a risk to safety or reputation. You may request termination by written notice. Sections that by their nature should survive termination (including ownership, license, disclaimers, limitations, indemnity, governing law, and dispute resolution) remain in effect.
Unless prohibited by local mandatory law, these Terms are governed by the laws of the Netherlands, excluding conflict-of-law principles. The courts of Amsterdam shall have non-exclusive jurisdiction over disputes not otherwise subject to alternative dispute resolution, provided that Nova Charm may seek injunctive relief in any jurisdiction.
Before initiating formal proceedings, you agree to attempt informal resolution by emailing a detailed notice to contact@jetcamstudio.com. If no resolution is achieved within 30 days, either party may pursue permissible remedies. The parties may mutually agree to confidential mediation or arbitration. Nothing in this section prevents Nova Charm from seeking equitable relief for potential IP misuse or data security breaches.
We may modify these Terms to reflect legal, technical, or operational updates. The “Last Updated” date will change accordingly. Material revisions may be communicated via prominent notices or direct communications. Continued use after the effective date of changes signifies acceptance.
